I have the mini 2 with the extra battery and I have flown it at night before. I did not have the extra battery at night and the video feed was a little bit choppy but it was still very easy to see and fly. Considering how slow it is, I doubt anyone would be able to hit it. But if you want to be cautious, then I would say no. A plane can be flown if it can be seen.
